Terms and Conditions

1. Specification of products
Specifications on any of Sovereign Hill's website regarding the products to be supplied by SHMA may differ from the actual products supplied from time to time. SHMA reserves the right to make any changes in the specification necessary to comply with any applicable legislation and to change the specification published on the website, without affording notice, provided that this does not materially affect the quality or performance of the products purchased. In all respects, and to the maximum extent permissible, SHMA makes no other warranties or promises about the products, and any implied warranties are excluded.

2. Availability
SHMA does not promise that products will necessarily be available at the time of purchase, and all products are offered for sale subject to availability. If a product is unavailable, SHMA will endeavor to contact you to advise you of this within 2 business days.

3. Pricing
The price of the products shall be the price displayed on the website on the date of your order (inclusive of GST but exclusive of delivery charges which are payable by you). All prices displayed on the website are quoted in dollars and must be paid in full, including delivery charges, except where discounts are offered as detailed on the website.

4. Order submission
When you click on the submit order page you agree to the terms and conditions of sale and SHMA will treat the order as confirmed. You are responsible for ensuring the accuracy of your order. SHMA shall endeavor to supply you, subject to availability, with the quantity and specification of products set out in your order. SHMA shall confirm each order made online via the internet or by email within 48 hours and will include a receipt with each parcel.

5. Delivery
Australia Post is SHMA's usual postal agent and they will make deliveries unless otherwise instructed and in accordance with the terms and conditions stipulated by them. All products will be delivered to the address that you have indicated on the order. Risk of damage of loss of product passes to Australia Post when they take possession of your order from us. Kindly note that any times quoted for delivery are approximate only and SHMA shall not be liable for any delay in the delivery of the product howsoever caused. Costs of delivery and/or postage in Australia and shall be added to the purchase price and deducted from your credit facility accordingly. The costs of delivery and/or postage outside of Australia may vary from the charge indicated. From time to time, SHMA will need to charge additional costs other than those indicate on our website. These charges shall be added to the purchase price and deducted from you your credit facility. For any further information on postage and delivery can be found at www.eparcel.com.au.

6. Cancellation, returns and replacement
SHMA will accept returns and cancellations and offer replacement goods commensurate with relevant legislation. We expect that you will be satisfied with your order but if you would like to cancel it and/or return the products ordered you must do so by contacting us within 7 working days of receiving your goods. SHMA will confirm any cancellation by email and will repay to you (the cost of products but not the postage costs of delivery or return) within 30 days after return of the goods. Goods must be returned by registered post and proof of purchase provided before any refund is issued. All refunds will be issued to the customer's purchasing credit card only - details of which may be enclosed with the return or can be phoned through. We will only refund the costs of return postage if the products are deemed faulty.

7. Resale
No items purchased from SHMA may be resold without the prior and express written consent of SHMA.

8. Privacy
SHMA is dedicated to keeping your details private. Any information, we collect in relation to you, is kept strictly secured. We do not pass on/sell/swap any of your personal details with anyone. We use this information to identify your orders and to personalise your shopping experience with us; that's all. SHMA uses cookies to allow you to login to your account, maintain a shopping cart and to purchase items in your shopping cart. Cookies sent to your computer from SHMA only last while you're browsing our website. We do not store persistent cookies on your computer. Cookies also allow us to give you a more personalised shopping experience by displaying products that interest you throughout our product pages, thus providing you with a more friendly, interesting and enjoyable shopping experience. Whenever you use our web site, or any other web site, the computer on which the web pages are stored (the Web server) needs to know the network address of your computer so that it can send the requested web pages to your Internet browser. The unique network address of your computer is called its "IP address," and is sent automatically each time you access any Internet site. From a computer's IP address, it is possible to determine the general geographic location of that computer, but otherwise it is anonymous.
We do not keep a record of the IP addresses from which users access our site except where you have specifically provided us with information about yourself, in which case we also record your IP address for security purposes. An example of this would be when proceeding to a checkout to finalise an order you may wish to make. After completing the form provided, your IP address will be stored along with a transaction number that allows us to track your order.. 9. Security Policy
When purchasing from SHMA your financial details are passed through a secure server using the latest 128-bit SSL (secure sockets layer) encryption technology and is the industry standard. 10. Limitation of liability
You acknowledge and accept that, to the extent permitted by law, SHMA's liability is limited only to refunding the price of or replacing the products as provided for above. SHMA is not responsible to you to any greater extent and in particular is not liable to you for any indirect or consequential loss (including without limitation personal injury, financial loss such as loss of profit, or otherwise) that you may incur regardless of whether such liability arises in contract, tort (including negligence), equity, breach of statutory duty or otherwise.

11. Changes to the terms and conditions of sale
SHMA retains the right to change its terms and conditions of sale at any time. We encourage users to review this document regularly to keep abreast of changes.

12. Law and jurisdiction
These terms and conditions of sale shall be governed by and construed firstly in accordance with the laws of the State of Victoria and then in accordance with the laws of Commonwealth of Australia. If any of these terms or conditions of sale should be determined to be illegal, invalid or otherwise unenforceable, it shall be deemed deleted and the remaining terms and conditions shall remain and continue to be valid, binding and enforceable.
